Geometric plans

Geometric plan is a technical base for execution of a decision and other documents concerning changes in the land registry and a base for execution of a change in the corpus of geodetic information and in the corpus of descriptive information of the land registry.

The most common cases in which geometric plans are executed are:

  • land division
  • location of a building or a water work (e. g. before final inspection)
  • supplementing of an allotment in a simplified way
  • determining the material burden

When ordering a geometric plan, it is necessary to report allotment numbers of given lands, cadastral community of the lands and the purpose of the geometric plan. The geometric plan has to be verified by an approved geodesist and appropriate cadastral station; afterwards it is handed over to the customer who can use it to change the data in the land registry, for final inspection and the like.

Staking out the land borders

Staking out the land borders is used to designate land borders in a terrain according to its geometric and position establishment in the land registry. It is executed most frequently in case the border is not apparent in the terrain, further e. g. before a fence or underground utilities are built, and the like. In case folding points of the border have been entered into the land registry with lower accuracy (with limit location deviation of up to 3 m), it is possible to make them more accurate based on approving statement of all neighbours to accuracy with limit location deviation of around 30 cm. A geometric plan is needed for better accuracy (this plan is than used only to make the land borders more accurate; it is not used to change the land borders or emergence of new allotment parts and the like).

Material burdens

A material burden is a material law limiting the owner of the property on behalf of another one, so that the owner is bound to bear something, perform something or restrain from doing something. Typical example of a material burden is the right to walk or ride across other people’s land, the right to pump water on other people’s land, the right to conduct underground utilities across other people’s land, and the like (there are plenty of kinds and their combinations).

The most frequent way of material burden occurrence is a written agreement; a material burden can occur by the law or by the decision of the court or other approved body, by prescription or by last will. Material burden can relate to all land or its part only. For a material burden related to a part of the land is necessary to execute a geometric plan stating its extent.

Land adjustments

Land adjustments serve to spatially and functionally adjust land in public interest. Lands are united and divided in a way as rational usage of agricultural land resources and better conditions of farming of proprietors (e. g. uniting of several scattered lands of one owner) are ensured. Further, to heighten ecological sustainability of the landscape and improve conditions of water management (limiting land erosion, retaining water by vegetation, and the like). Access to newly arranged lands is enabled via current or new unpaved road. The subject matter of land adjustment is mainly agricultural land. The new organization draft has to take into account also local plan, in case it has been approved in the particular area. The results of land adjustments are used for renewal of cadastral documentation (a new digital cadastral map will occur).
